In the United States, drivers distraction is defined (as per guidelines from the National Highway Traffic Safety Administration) as anything that diverts the drivers attention from the primary tasks of navigating the vehicle and responding to critical events. Put it differently, a distraction is anything that takes your eyes off the road (visual distraction), your mind off the road (cognitive distraction), or your hands off the wheel (manual distraction).

- Grooming activities

Texas Insurance Code Protects Policy Holders from Unfair Insurance Practices by Lisa Sechelski
Hurricane Ike wreaked havoc on Texas coastal communities.
It’s been more than 30 days since Hurricane Ike slammed into the Texas Gulf coast. In its wake, is estimated to be as much as $18 billion or more in insured damages. The most severe damage was inflicted on coastal communities like those on Galveston Island and Bolivar peninsula. But due to the unusually large size of the storm, widespread damage was inflicted over a much larger inland region covering the entire Houston-Sugarland-Baytown metropolitan area. With an estimated population in this affected area of nearly 6 million people, it is easy to imagine how insured losses can mount very quickly.
Living and working in the Houston area has almost returned to normal again. The last people I knew of who didn’t have electricity, have had their power restored for almost a week now. The portable generators are finally silenced, the long lines at gas stations are gone, and although the cleanup continues, nearly all streets are clear of debris (if you discount the piles along the curbs). For most of us, the worst of it is over. For others however, the real headaches are just beginning as insurance claims for hurricane damage are made and, in an alarming number of cases, denied.
Don’t be cheated.
Some insurance companies will go out of their way to avoid paying you full value for your insurance claim. In the wake of Hurricane Katrina, the Louisiana State Attorney General filed a lawsuit against six major insurance companies including State Farm and Allstate. The suit claimed that insurance companies "coerced their policyholders into settling their claims of damages for less than their value by editing engineering reports, by delaying payment and by forcing policyholders to litigate claims to receive full value." The suit relied on information about a study conducted for Allstate by a major consulting firm that advised the insurance company to don boxing gloves and pummel anyone who didn’t settle for pennies on the dollar. A book titled Good Hands to Boxing Gloves tells the story which is now yesterday’s news. Or is it?
My own home suffered substantial damage from the hurricane and I’m happy to report that my own insurance provider acted quickly and in good faith to settle our homeowners insurance claim fairly. But reports of unfairly denied claims, delays in adjusting claims, and unfair settlement offers are emerging. Naturally, business owners and residents who are faced with such problems are frustrated. Fortunately, Texas law provides ample protection for policy holders from unfair insurance practices. But few policyholders are informed about their rights and the protection they have under the law.
Prompt Payment of Insurance Claims
Texas law, specifically the Prompt Payment of Claims Statute provided in the Texas Insurance Code, imposes certain deadlines for an insurance company to acknowledge, investigate, and accept or reject a claim. Policy holders may not even realize that if their insurance company fails to fulfill its duties within the prescribed deadlines, they can be liable for the full amount of the claim, plus damages including attorney’s fees and an additional 18% per annum in addition to the amount of the claim.
Duties of the Insurer
The following duties are imposed on insurance companies after they receive notice of a claim:
* They must acknowledge receipt of the claim. Each separate claim requires separate acknowledgment.
* They must record the acknowledgment, making a record of the date, means, and content of the acknowledgment if it is not in writing.
* They must begin an investigation of the claim.
* They must request from the claimant all items, statements, and forms that the insurance company reasonably believes will be required from the claimant. Multiple requests may be permitted when reasonably necessary, but multiple incremental requests may in certain cases be a violation of the statute.
With a few exceptions, most insurers must perform these duties within 15 days following receipt of notice of a claim.
Additional Duties & Deadlines
Once the insurance company receives all items, statements, and forms reasonably required by them, they are obligated to fulfill the following duties:
* The insurer must notify the claimant in writing within 15 business days that it accepts or rejects the claim. There is an exception permitted if the insurer suspects arson, and the insurer can also get a 45 day extension of the deadline.
* If the insurance company rejects the claim, the rejection notice must state the reason(s) for rejection.
* If the insurance company cannot accept or reject the claim by the normal deadline, they must notify the claimant and explain why more time is needed.
* Even if the insurance company gives notice of a requirement for additional time, they must still accept or deny the claim within the additional 45 day period.
* If the claim is valid, the insurance company must pay the claim within 60 days after receiving the items requested from the claimant. This is a strict deadline and if an insurer fails to meet it, they are liable for the claimant’s attorney’s fees and damages of an additional 18% per annum in addition to the amount of the claim.
* The insurer must pay the claim within 5 business days after notifying the claimant that the claim will be paid.
* If the insurance company makes an act by the claimant a condition of payment, then the deadline is 5 business days after the act is performed. (Surplus lines insurers have 20 days for fulfill their obligations under either scenario.)

In 1992 William L Wilks was president and dean. South Texas is the ninth biggest law college in the U. S. And is found on a complete town block in central Houston. Buildings include the South Texas University of Law Tower, the Roy and Lillie Cullen Building, and the Garland R Hiker Patio . The campus became called the Jesse H Jones Legal Center at the South Texas School of Law in 1984.
The college permanently homes the 1st and fourteenth Texas Courts of Appeals. Coursework can be finished on a full-time or a part-time basis. In 1998 South Texas changed into a member of the organisation of Yank Law Colleges and signed a connection agreement with Texas AM School . In the autumn of 1999 there were 1,220 scholars enrolled at the college ; about 70 % attended full-time. Frank T Read was president and dean of the faculty in 2001.

* One of every five workplace fatalities is a construction worker.
* There were 1,225 fatal occupational injuries in construction in 2001, excluding fatalities on September 11. Also in 2001, there were 481,400 nonfatal injuries and illnesses in construction. Incidence rates for nonfatal injuries and illnesses were 7.9 per 100 full-time equivalent workers in construction, and 5.7 per 100 full-time equivalent workers in all private industry in 2001.
* Because only about 10% of construction companies employ more than 20 workers, the great majority have no formal job safety regulations or programs in place.
* In 1992, the "lost-workday" rate for workers in the construction industry was 5.7 per every 100 full-time workers. The lost-workday due to injury rate in the construction industry is greater than in any other industry.
* Nationwide, about 15% of workers’ compensation costs are attributable to injuries in the construction industry.

Almost every injury that construction workers suffer could makes the worker eligible for workers compensation rights. Those limited rights, however may be supplemented by legal actions against others who have responsibility for various activities on the job site, including construction managers, general contractors, subcontractors, equipment manufacturers, etc. The individual circumstances of the accident and how the complicated laws will be applied to it will affect these rights.

An OSHA compliance officer may have a workers’ representative conduct the inspection with them, as it is their right. A union member, if there is one, or the employees choose the representative. At no time may the workers’ representative be chosen by the employer. The inspector may conduct a comprehensive inspection of the entire workplace or a partial inspection limited to certain areas or aspects of the operation. At the end of the inspection, the OSHA inspector will meet with the employer and the employee representatives to discuss the abatement of any hazards that may have been found. These need to be corrected or serious penalties and legal liabilities may arise.

If you or your spouse are unable to agree on the terms of your divorce, everything will be decided by a judge in a final court trial. You have a right to request a jury trial. Most people are familiar with jury trials – where a jury of citizens from your community will decide the issues.
But family law courts are overcrowded and overworked. While a jury trial is your right to request, asking for one will give the judge a negative impression of you before your case ever begins. In many states, including Florida, the bench trial is the trial of choice for a divorce case. A bench trial has no jury. The judge serves as the jury and also serves as the judge. The bench trial concentrates all the decision making power in one person, the judge. So in a typical divorce, the judge is the most important person in your life. So it is best to always "play to the judge" throughout your case.
The vast majority of judges are intelligent, compassionate, and concerned with doing the right thing. But judges are human and you must guide your behavior in, and out of court, by how you may appear to another person. From the start of your divorce to the final judgment (and possibly beyond) you must take "the high road." This means you should act rational and with integrity. Don t act up, or do anything the judge may use in a decision to punish you.
Always tell the truth and do what you promise to do. If your actions don’t match your words, a judge will pick up on that. Be the person everyone admires throughout your divorce and the judge will pick up on that as well. A judge will frequently give the benefit of the doubt to a person that appears to be rational and honest. Further, a judge that gives you the benefit of the doubt will go out of his or her way to do the right thing.

However, you must be aware that as human beings, judges can act unpredictably. You may get a certain ruling because the judge "woke up on the wrong side of the bed" that day and you looked like the bad-guy in court. Again, you will always come out best if you maintain a squeaky clean image. During your hearing, avoid appearances of instability. Even if you don’t speak during your trial, the judge is probably looking at and evaluating you.

Finally, always be aware your actions and words are being measured and analyzed by a stranger. But in this case, the stranger is a judge and has power over your life and your divorce.

Ten years ago, a former colleague of mine, a fine teacher and person, was tragically killed in a car accident in British Columbia. He was on vacation with his daughter who miraculously survived the accident. What happened was a classic case of sleep deprivation: my friend was anxious to make his way to a chosen destination and despite his fatigue and the fact that he had been on the road for over 6 hours, he made the decision to drive through the night. He never made it there.
That there is a direct correlation between sleep deprivation and traffic accidents cannot be disputed. In 1998, 24,318 deaths were cited from accidents related to sleep deprivation in the US. There were as well 2, 474,430 disabling injuries resulting from accidents where decreased mental efficiency and attentiveness due to sleep loss was the major causative factor. In fact, a major review conducted in 1996 suggested that the oil spill of the Exxon Valdez, the destruction of the space shuttle Challenger, the nuclear accident at Chernobyl( costing over 50,000 lives) and the near nuclear accidents at the Three Mile Island and Peach Bottom reactors were all associated with sleep deprivation of the personnel involved.
Sleep deprivation is often caused by sleep disorders which are unknown to the subjects themselves. Sleep apnea, for example, is a common cause for sleep deficit. A study at the Sleep Disorders and Research Center of Stanford University Medical School showed that truck drivers identified with sleep disordered breathing had a two-fold higher accident rate than drivers without sleep-disordered breathing. Sleep disordered breathing, commonly known as sleep apnea, affects 15 million people in the United States. This condition, characterized by suffocation and oxygen deprivation which wake the subjects up several times in the course of the night, is responsible for daytime sleepiness and fatigue. Put these subjects on the highway and we have a recipe for disastrous traffic accidents.

Perhaps an examination of the influence sleep deprivation has on our mental acuity and performance level can shed light on how we can protect ourselves and others from the disastrous consequences of sleep fatigue.
What happens to you when you are sleep deprived? According to the Traffic Research Center, these are the influences of sleep deprivation on performance:
a) Slower reaction time: sleeplessness slows down your reflexes; reaction time slows down, preventing you from stopping in times of danger.
b) Decrease in concentration levels: When you are overly tired, your attention span decreases. Most people are subject to a decrease in attention every 90-120 minutes; however, sleepiness makes this decrease even worse and it can cause accidents when you fall asleep at the wheel.

c) Disorder in information processing: Sleepiness is very much like being under the influence of alcohol or drugs. When you are sleepy, your mental and psychomotor skills diminish. In one study, a group of subjects were kept awake for 28 hours; another group was given alcoholic drinks every half hour. When both groups were tested for hand-eye coordination, the ones who were sleep deprived performed equally bad as the ones with 0.5 blood alcohol level.
What are the factors that have a direct effect on a driver s tiredness?
a) The amount of time the driver has been on the road. When a driver has been on the road for 8 or more hours, his driving performance is impaired. The risk of accidents increases.
b) The amount of sleep the driver had the night before. Not having any sleep for 16 hours has a serious impact on driving performance. Research shows that the sleeping period of drivers who are involved in road accidents are shorter than the ones of those who had sufficient sleep.
c) Sleep disorders and Obesity. Sleep disorders like sleep apnea or narcolepsy in truck drivers are a major risk factor. In the same Stanford University Study mentioned above, even weight can seriously affect the frequency of traffic accidents. Obese drivers with a body mass more than 30 kg also presented a two-fold higher accident rate than non-obese drivers.
d) Environmental factors. The lack of resting and parking facilities for drivers is another factor that contributes to the accident rate.
What can we do to ensure that we get adequate sleep?
a) Set up a bedtime ritual the same time to bed, the same routines like reading in bed or listening to relaxing music.
b) See your doctor if you have snoring or breathing problems, daytime fatigue, morning headaches, night time choking episodes. You could have sleep apnea which can be treated with new devices and technology.
c) If you are overweight, take the steps to bring down your weight. Obesity is a common factor in sleeplessness.
d) Get into a routine of exercise during the day. Do not exercise after 7Pm as the activity could be over stimulating and prevent you from sleeping.
